People assume a jury decides a case based on the testimony and the exhibits. Those matter enormously — but jurors are human beings sitting in a room for days with very little to do except observe. And they observe everything.
They notice how a defendant reacts when a witness says something untrue. They notice whether someone looks bored during testimony about a serious injury. They notice how a person treats their own attorney at counsel table, whether they show up on time, how they're dressed, and what they say in the hallway during a break — where jurors are often standing ten feet away. I have watched jurors form opinions in the first thirty minutes of a trial that no amount of evidence later dislodged.
None of that is legally relevant. Jurors are instructed to decide the case on the evidence. But jurors are people, and people read other people constantly and mostly unconsciously. Having sat at the State's table as a former Chief Prosecutor, I watched juries respond to things that never appeared in a single exhibit.
This is one of the practical reasons preparation matters. A good lawyer prepares a client for how a trial actually feels — the long stretches of tedium, the moment a witness lies about you, the instinct to react. Managing that is not about performing for the jury. It is about not handing them a reason to doubt you that has nothing to do with the facts.
