By the time the first witness is sworn, one of the most important decisions in a trial has already been made: who is sitting in the jury box. Jury selection — voir dire — is where a case can quietly be won or lost.
During voir dire, the lawyers talk with potential jurors about their attitudes, experiences, and biases. The goal is not to find jurors who already agree with you; it is to identify the people who genuinely cannot be fair, and to seat a panel that will keep an open mind and hold the State to its burden of proof beyond a reasonable doubt.
