▶ Watch: The Criminal Justice System Is Adversarial

The American criminal justice system is adversarial — that's not a flaw, it's the design. One side, the State, is built to prove guilt: it has a prosecutor, police investigators, crime labs, and the resources of the government. The system assumes the other side has an equally dedicated advocate pushing back, testing the evidence, and protecting the accused. When a defendant has no lawyer, that balance collapses, and it collapses against them.

People sometimes expect the judge or even the prosecutor to "look out for them." They can't. The judge is a neutral referee. The prosecutor's job is to represent the State, not you. No one in that courtroom is assigned to protect your rights except your own attorney. That's the entire point of having one.

Understanding the adversarial nature of the system is also why experience on both sides is so valuable. As a former Chief Prosecutor who is now Board Certified in criminal law, Brian Foley knows how the State builds a case — which means he knows where those cases break down, what evidence is actually strong, and how to hold prosecutors to their burden.
